BID START SCRIPTING SERVICES TERMS AND CONDITIONS:

This agreement describes the terms and conditions applicable to all members, i.e. "Freelancers and Buyers" of the Bid Start Scripting Service. Applicants / Members must agree to the following Terms and Conditions. In the event a member breaches or otherwise fails to comply with any provision of these Terms and Conditions then in addition to any other remedy available to Bid Start. The Bid Start Scripting Service may terminate the participation of such member in the service and/or may withhold any payments relating to participation in the service due to such member from the Bid Start Scripting Service and may or may not result in a BANNING!

We will absolutely try everything from warnings to arbitrations before we resort to with holding of funds and Banning.

ELIGIBILITY REQUIREMENTS:

Bid Start Scripting Services shall have absolute discretion as to whether or not it accepts a particular applicant or site for participation in the service.

We currently do not have any policy that makes any site or individual uneligibile to use Bid Start, however, we will judge you based on your preformance and behavior.

If any member or members act unprofessional and or participate in any misleading or illegal activities, we at Bid Start will take appropriate measures to deal with such members.

We will assist any federal or government agencies which need our help.

REMOVAL FROM THE BID START SCRIPTING SERVICE:

Bid Start reserves the right to terminate the participation of any member or site without reason but expressly including any member site that Bid Start judges to be in violation of the Terms and Conditions.

Members in violation of Bid Start's Terms and Conditions will be immediately deactivated. Bid Start may deactivate members with no prior notification. Members found in violation of the Terms and Conditions will not receive any credit or payment from Bid Start. Members that are terminated by Bid Start on any basis other than violation of these Terms and Conditions will be entitled to receive any payment due from Bid Start.

No matter what, if we find you in violation of our terms we will send you a warning prior to deactivating your account, we may temporarily ban you until you fix the violation and if the violation is not corrected within 48 hours of your warning or you continue to violate them, then we may delete your account and absorb your funds.

PAYMENT POLICY:

Bid Start Scripting Service will generally prepare and mail checks if the member requests it, only if their account balance is equal to or greater than $25., there is a $2.50 charge for us to prepare and mail your check. This also applies to payments made through the PayPal service, the charges are less of course. All amounts are stated in and all payments will be made in US funds. We verify all deposits and might ask you to verify yours; If you refuse to send verification information via E-mail, Fax or Phone, we reserve the right to refund the deposit and terminate your account. Bid Start reserves the right to suspend a withdrawal if the source of the funds is suspected to be fraudulent. Any funds received from an account having made a fraudulent deposit (e.g. stolen credit card) will be reversed immediately. If in a fraudulent payment situation a withdrawal has already been processed, you will be expected to return the funds to your Bid Start account or face account termination and reported to the proper authorities for credit card theft.

As previously stated, any member site that Bid Start removes from the service due to violation of the Terms and Conditions will receive no credit or payment and we will ban your I.P address and email address to help us prevent you from rejoining under anther account.

COPYRIGHTS:

No copyrighted material can be posted on the Bid Start System. This includes scripts which are sold by the author. Only posting sections of these scripts, as examples, will be permitted. A "section" being no more than 10% of the script's contents. This is meant to protect the author's rights,especially if whom you are dealing with is not the true Author.

MODIFICATIONS:

Bid Start Scripting Service reserves the right to change the member Terms and Conditions at any time. It is the member's responsibility to check these Terms and Conditions and stay informed. In the event Bid Start offers any additional or replacement services then this agreement shall apply to such services in the absence of any new agreement specific to such services which is entered into between the parties.

However, we keep new and updated services and features available on our forum, so it is advisable to visit the forum often to stay informed. One of our recent improvements is that when you join as a member to the Bid Start Scripting Service you are automatically signed up to the forum with the same username and password, that is until you change it. OWNERSHIP RIGHTS:

All members agree that all information contained on a website operated by the Bid Start Scripting Service, and all information compiled by Bid Start through operation of the affiliate program, is the proprietary information of Bid Start. Personal information provided by members to Bid Start will be kept strictly confidential and will not be distributed to any third party under and condition for purposes which would benefit us financially and cause you undue hassle of dealing with spam. The only circumstance that would preclude this agreement would have to be a condition where legal matters are involved in illegal activities where Bid Start is under legal pressure from the federal government to comply in the apprehension of a member.

CONTACT POSTING :

We have lifted the contact posting rule for now as it has been requested by members who stated that it henders business. So as a result of the removal of this restriction it is now required that Buyers pay their commission to Bid Start prior to having their projects posted and Freelancers pay no commissions at all. To make this an open and easy site for members it now costs to post a project and after that you will have open access with communication with each other. Be advised however, it is fine if you wish to communicate off site, but doing business off site could be risky, we hold all funds until both parties are satisfied and we can not be held responsible if you deal with a member you decided to deal with off site.

AVOIDING COMMISSIONS:

You are strictly prohibited from attempting to negotiate the fee for a project with another member directly (outside of Bid Start) after that project has been created/opened and before that project has been closed (basically, during an ongoing project). But this also applies to any project that was closed without a programmer being chosen, and then contacting them about the project anyway. Both parties are responsible for notifying Bid Start if the payment amount increases (above the bid amount) after the project is closed. Receiving a larger amount than the original project bid, without notifying us, will be considered an attempt to avoid the commissions. When a programmer requests a withdrawal, we always review all payments received for each project to verify that they match the bid. If at the time of a withdrawal request the programmer has failed to notify Bid Start staff of a payment received above the amount of his bid (a total payment above US $100), Bid Start reserves the right to fine both parties accordingly, generally a $50.00 fine will be applied and doubled each amount for every $100.00 beyond accepted bid. We may take further action if neccessary. We believe our commissions are very fair and justified for the service we provide, therefore we will absolutely not tolerate any of this activity on the Bid Start System.

BIDDING:

Freelancers can only place bids that equal the total amount of money they are requesting for the project. You cannot post an hourly bid or any other abnormal type of bid. This applies to Webmasters too. Webmasters cannot create projects that directly or indirectly require Freelancers to place hourly or other abnormal bids. If you have job offer than you can post a job on our job board for a $20.00 fee that runs for 45 days.

FEATURED PROJECTS:

You pay $20.00 fee to have your project featured and are granted a special graphic and priority placement over regular bids and of course there is no commission fees for a featured listing.

JOB POSTINGS:

If you want to post a full time job or a temp. position or any position requiring fees that can not be bid on, you can go to the job posting section at: Post Job

The conditions for posting on the job board is as follows, a cost of $20.00 will be applied and your help wanted ad will run for 45 days.

ADVERTISING

You are prohibited from advertising your website on Bid Start. Any URL posted in a bid, project description, or the message board, must relate to a project on Bid Start. An example of a permissible URL: your off site portfolio or resumé page.

You can however, post an unlimited amount of graphics and urls that are relevent to your work for your portfolio.

You can add and delete your graphics and urls at will.

As a freelancer you can post an unlimited number of graphics and urls from your management area which is automatically added into your Bid Start portfolio.

ESCROW:

If you want your money to stay in escrow until the project is completed, well we have that option available to you. It is a great idea to use escrow especially when big money is involved or this is the first time dealing with a member you never worked with before or the member has no rating or feedback yet.

Bid Starts Role:

The Bid Start Scripting site functions as a venue to connect Webmasters and Freelancers in a virtual marketplace. As a neutral facilitator, Bid Start is not directly involved in the actual transactions between users of the Site. As a result, Bid Start has no control over the truth, accuracy, quality, legality, or safety of postings made by users. Because verifying the identity of a user on the Internet is difficult, Bid Start cannot and does not confirm the identity of users. Bid Start also does not confirm nor verify the qualifications, background, or abilities of users. Therefore, We recommend that You be careful and exercise common sense and good judgment when dealing with any member on the Site. You are enouraged to review our Project Guidlines before taking part in a project. If you are unsatisifed with another member, the most Bid Start can do is ask that you give an honest review of the member. We cannot refund the money you have sent to someone, we are not responsible for your transactions. Bid Start is not responsible for fraudulent payments made by users and cannot be held liable for financial loss incurred from fraudulent transactions. It is the receiver's responsibility to verify the identity and background of the sender. It is very important to read reviews left by other members, this procedure helps aid you decide if you which to do business with a particular member or not.

We no longer make financial transactions automatic, so your freelancer does not get paid until you accept the work and rate them and send the transaction. The money you send to the freelancer stays in the Bid Start account until we have reviewed the transaction are satisfied that both parties are satisfied with the completed project. Once we have released the funds to the freelancer we are no longer responsible for your money as this contract is complete and if you decide that you are now unhappy, you will have to deal with the situation yourself as we took every precaution prior to releasing the funds.
